1. Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of the r3Converse platform, website, dashboard, widget, and related services (the "Service"). By creating an account, accessing, or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.
2. Description of Service
r3Converse provides an AI-powered sales chatbot widget and sales automation platform that allows businesses to engage website visitors, capture leads, generate commercial proposals, and manage conversations from a centralized dashboard. The Service includes web-based software, embeddable widgets, API access where available, and customer support according to your plan.
3. Account Registration
To use the Service you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use or security breach. We reserve the right to suspend accounts that violate these Terms.
4. Plans, Billing and Cancellation
We offer several subscription plans, which are described on our Pricing page. • Paid plans are billed in advance on a monthly or annual basis. • You may upgrade, downgrade, or cancel your subscription at any time from your billing settings. • Downgrades take effect at the next billing cycle. Upgrades take effect immediately and may be prorated. • We offer a 7-day free trial with no credit card required. After the trial, you must select a paid plan to continue using the Service. • All fees are non-refundable except where required by law or at our sole discretion. • We may change our prices upon 30 days' notice.
5. Acceptable Use
You agree to use the Service only for lawful purposes and in compliance with these Terms. You may not: • Use the Service to send spam, phishing, or unsolicited messages. • Attempt to access, interfere with, or disrupt our systems or other users' accounts. • Use the Service to collect sensitive personal data prohibited by law without appropriate legal basis. • Reverse engineer, copy, or resell the Service without authorization. • Use the AI to generate illegal, defamatory, discriminatory, or harmful content. We may suspend or terminate accounts that breach these rules.
6. User Content and Conversations
You retain ownership of the data you and your visitors submit through the Service, including conversation transcripts, lead information, and proposals. By using the Service, you grant us a limited license to process, store, and display this content solely for the purpose of providing the Service. You are responsible for ensuring that you have the necessary rights and legal basis to collect and process visitor data, including obtaining consent where required by law.
7. Intellectual Property
All rights, title, and interest in the Service, including software, designs, logos, trademarks, and documentation, belong to r3Converse or our licensors. You may not copy, modify, distribute, or create derivative works of our intellectual property without our prior written consent.
8. Service Availability and Support
We aim to keep the Service available and reliable, but we do not guarantee uninterrupted access. Scheduled maintenance, updates, and unforeseen issues may cause temporary downtime. Support is provided according to your plan: email support for all plans, faster response times for Growth and Pro, and priority support for Enterprise.
9. Limitation of Liability
To the maximum extent permitted by law, r3Converse and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. Our total liability for any claim arising from these Terms or the Service will not exceed the amount you paid us in the 12 months preceding the claim. Nothing in these Terms limits liability for fraud, gross negligence, willful misconduct, or death or personal injury caused by negligence.
10. Termination
You may terminate your account at any time from your account settings. We may suspend or terminate your access if you breach these Terms or if required by law. Upon termination, your right to use the Service ceases immediately. We will delete your data in accordance with our Privacy Policy, except where retention is necessary for legal or billing purposes.
11. Governing Law and Jurisdiction
These Terms are governed by the laws of Spain, without regard to conflict of law principles. Any dispute arising from these Terms or the Service will be subject to the exclusive jurisdiction of the courts of Spain, unless mandatory consumer protection laws require otherwise.
12. Changes to These Terms
We may modify these Terms from time to time. We will notify you of material changes at least 30 days before they take effect. Your continued use of the Service after the effective date of the changes constitutes acceptance of the revised Terms.
